Terms of Service

1. Service Description
Safebuilds provides a compliance-first, no-code application builder for regulated industries including healthcare, legal, and real estate (“the Service”). The Service includes form builders, compliance tagging tools, audit trail generation, team management features, and related functionality accessible via app.safebuilds.app.
By creating an account or using the Service, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
2. Acceptable Use
You may use the Service only for lawful purposes. You agree not to:
- Use the Service to collect data in violation of applicable privacy laws
- Attempt to reverse engineer, decompile, or extract the source code of the Service
- Use the Service to transmit malware, spam, or unauthorized communications
- Resell, sublicense, or white-label the Service without written permission
- Access the Service in ways that circumvent usage limits or rate limits
- Use the Service to process data in industries not supported without prior written agreement with Safebuilds
3. Data Ownership
You own your data. All form configurations, submissions, audit logs, and content you create or collect through the Service remain your property. Safebuilds processes this data on your behalf as a data processor, not a data controller.
You grant Safebuilds a limited license to store, process, and transmit your data solely as necessary to provide the Service. This license does not permit Safebuilds to use your data for any purpose other than providing the Service to you.
4. Compliance Disclaimer
Safebuilds provides tools designed to support regulatory compliance. However:
- Safebuilds does not provide legal, medical, or compliance advice. The Service is a technical tool, not a compliance consultant.
- You are responsible for determining the specific regulatory requirements applicable to your organization and ensuring the Service meets those requirements.
- Use of the Service does not guarantee compliance with HIPAA, state privacy laws, or any other regulatory framework. Compliance depends on how you configure and use the Service.
- For Healthcare customers requiring HIPAA compliance, a Business Associate Agreement (BAA) must be executed with Safebuilds before processing PHI. BAAs are available on Enterprise plans.
5. Service Level Agreement (SLA)
Safebuilds targets 99.9% uptime for the Service, measured monthly, excluding scheduled maintenance windows. Scheduled maintenance is announced at least 24 hours in advance via the Safebuilds status page and email notification.
In the event of downtime exceeding the SLA, customers on Professional and Enterprise plans are eligible for service credits. Enterprise customers should refer to their Order Form for specific SLA terms.
6. Liability Limitations
To the maximum extent permitted by applicable law, Safebuilds' total liability to you for any damages arising from or related to these Terms or your use of the Service shall not exceed the amounts you paid to Safebuilds in the 12 months preceding the claim.
Safebuilds is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or goodwill, even if Safebuilds has been advised of the possibility of such damages.
7. Termination and Data Portability
Either party may terminate these Terms at any time. Safebuilds may terminate or suspend your account immediately for material violations of these Terms.
Upon termination:
- You may export all your data (forms, submissions, audit logs) in CSV or PDF format before cancellation.
- Safebuilds will retain your data for 30 days after account termination, then permanently delete it per our data retention policy.
- Annual subscriptions canceled mid-term are not eligible for pro-rata refunds unless required by applicable law.
8. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware, and both parties consent to exclusive jurisdiction there.
9. Changes to These Terms
We may update these Terms from time to time. We'll notify you of material changes via email and an in-app notification at least 30 days before changes take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
